Refund Policy

This Refund Policy applies to all paid subscriptions across the Kinetic product line — including KineticBrand, KineticPrompt, KineticCopy, KineticPM, and KineticTrade — operated by ClanConsulting Ltd., Sofia, Bulgaria.

1. Digital Content — No Refunds After Use

Our Services deliver digital content and AI-generated outputs. Under EU Directive 2011/83/EU (Consumer Rights Directive), Article 16(m), the right of withdrawal does not apply to digital content that has been fully delivered with the consumer's prior express consent and acknowledgement that the right of withdrawal is lost.

How this works:

When you subscribe to a paid plan, you will expressly acknowledge and consent to the following before accessing any paid features:

“I understand that by accessing premium features, I expressly request that ClanConsulting Ltd. begin delivering digital content immediately. I acknowledge that I lose my right of withdrawal once I access any AI-generated output, research result, brand strategy, prompt, or other premium feature.”

Once you use any paid feature — including running the Validator, using Brain coaching, generating Enhancement reports, building prompts, accessing research outputs, or any other AI-powered feature — no refund is available.

2. Before You Subscribe

You will see a clear checkbox requiring your express consent before completing any paid subscription. You cannot subscribe without confirming you understand the no-refund policy upon use. This ensures full transparency and EU legal compliance.

3. Exceptions

We will issue refunds ONLY for:

  • Duplicate charges — billed twice for the same period due to a billing error
  • Unauthorised charges — your payment method was used without your authorisation
  • Extended outage — Services entirely inaccessible for more than 7 consecutive days during a paid billing period (pro-rata refund)

We will NOT issue refunds for: dissatisfaction with AI outputs, deciding you no longer need the service after using paid features, failing to cancel before renewal, account termination due to policy violations, or mid-cycle tier downgrades.

4. Cancellation

Cancel anytime in your account settings. No further charges will be made. Paid features remain active until the end of your billing period, then your account reverts to the free tier. Cancellation does not entitle you to a refund for the current period.

5. How to Request a Refund (Exceptions Only)

Email clan.consult.dk@gmail.com with: your account email, date and amount of charge, the specific reason (duplicate, unauthorised, or extended outage), and any supporting evidence. We respond within 5 business days. Approved refunds are processed via Stripe (5–10 business days).

6. Your Consumer Rights

This policy complies with EU Directive 2011/83/EU Art. 16(m), the Bulgarian Consumer Protection Act, and EU Regulation 524/2013. The European Commission's ODR platform is available at ec.europa.eu/consumers/odr/. You may also contact the Bulgarian Commission for Consumer Protection (CPC) at kzp.bg.
